Kobe Suma Sea World Terms of Use
Article 1: Scope of Application
These Kobe Suma Sea World Terms of Use (the “Terms of Use”) apply to guests using Kobe Suma Sea World and its ancillary facilities (collectively, “Sea World”) operated by GRANVISTA Hotels and Resorts Co., Ltd. (“GRANVISTA”).
Article 2: Tickets
- Admission requires a ticket (“Ticket(s)”) to enter Sea World. Tickets used for entry may be asked to be presented inside Sea World.
- Ticket handling (e.g. details of ticket types and prices) are posted on the official Kobe Suma Sea World website.
- Terms and conditions of ticket sales contracts, payment methods, delivery methods, refund conditions, etc., shall be subject to the terms and conditions of sales set forth by each distributor. The “Terms and Conditions of Kobe Suma Sea World Online Service” shall apply to Tickets sold by GRANVISTA.
- In the event that the unauthorized resale of Tickets for commercial purposes is discovered, the tickets concerned, and all tickets purchased by those involved in the unauthorized resale (regardless of whether or not the tickets are intended for resale) will be invalidated as a violation of the Terms of Use and/or our Online Reservation and Purchase Service Terms of Use. In such cases, the Tickets concerned and invalidated Tickets cannot be used to enter Sea World, and no refund or other compensation will be provided by GRANVISTA.
Article 3: Precautions regarding Use
- In addition to the Terms of Use, at Sea World, guests must comply with the terms of use, precautions, and requests from GRANVISTA and its employees (“Cast”) displayed for each facility and service.
- The terms and conditions of use of the facilities and services of Sea World, as well as the business activities of Sea World, are subject to change without notice.
- Some facilities and services may require reservations through the official website, advance payment by credit card, or advance reception in Sea World.
- Some facilities and services may not be available for use on the day of admission.
- Acceptable methods of payment differ for each facility and service.
Article 4: Prohibited Behavior
Guests shall not engage in any of the following acts at Sea World. Violations of the provisions of this article shall be determined by GRANVISTA and the Cast based on reasonable grounds.
- unauthorized entry or unauthorized use, counterfeiting or alteration of tickets (including partial tickets such as two-dimensional codes);
- unauthorized use of credit cards, electronic money, etc.;
- feeding animals food other than that provided by Sea World;
- using hand signs, gestures, or whistles targeting the animals without Sea World’s permission;
- acts of mischief that injure animals, or damages exhibits, or equipment;
- putting hands or faces inside the exhibit tanks or pools;
- behavior that inconveniences other guests or the Cast, and behavior of a violent, or potentially violent nature;
- transfer or exchange of Tickets (including partial tickets such as 2D codes) or rights to use performances, facilities, or services (including Discovery Guidance, advance event reservations, etc.) between guests, and the transfer or exchange of money in connection therewith;
- entering prohibited areas;
- climbing or hanging from decorations, fences, etc.;
- placing luggage or other items to secure a seat in the performance venue or to occupy space in Sea World;
- using skateboards, roller blades, roller skates, personal mobility vehicles (mainly one-person electric vehicles, excluding electric wheelchairs), kickboards, tricycles, and drones;
- smoking (including electronic cigarettes) outside of designated smoking areas;
- any act that infringes or may infringe upon the copyrights, trademarks, other intellectual property rights, property rights, trade secrets, privacy, portrait rights or other rights of other guests, third parties, GRANVISTA, its affiliates, or the Cast;
- taking photographs in areas where photography is prohibited and taking flash photography in areas where the use of flash is prohibited;
- publication or posting of photographs, images, videos, or movies taken in Sea World for profit-making or commercial purposes on social networking services or other Internet sites;
- any act that violates or may violate the law or public order and morals;
- The following items may not be brought into Sea World:
- items possession of which is prohibited by law, such as guns, swords, and poisonous substances
- weapon-like products (including handmade toys)
- gunpowder (including fireworks, firecrackers, etc.), substances which may ignite such as volatile oil
- drones, radio-controlled models, etc.
- pets and other living creatures (There are no areas to keep pets. Please inform us in advance if you wish to bring a guide dog, hearing dog, or service dog.)
- items that emit a noticeably bad odor
- noise-emitting items
- photography aids such as camera monopods, tripods, or selfie sticks
- other items that Sea World deems inappropriate
Article 5: Refusal of Entrance, Removal from the Premises and Reporting to the Police
In the following cases, GRANVISTA may refuse to allow guests to enter Sea World, ask guests to leave Sea World, invalidate guests’ Tickets, refuse to allow guests to watch a performance or use the facilities or services, report guests to the police, and refuse guests any and all future transactions with GRANVISTA (including but not limited to Ticket purchase, admission to Sea World, purchase of goods or services, and membership in the Membership Program) and entry to GRANVISTA’s premises. Any violation of the provisions of this article shall be determined by GRANVISTA based on reasonable grounds. In addition, we may check guests’ identification documents (e.g., driver’s license, health insurance card, passport) in taking action in accordance with this Article.
- when a guest commits an act that violates the prohibited acts stipulated in the preceding article, or the Terms of Use
- when a guest fails to comply with the terms of use and/or precautions displayed for each facility and service, or requests from the Cast
- when any of the following applies to a guest
- When a guest clearly has an infectious disease, etc.;
- When a guest is found to be a member of an organized crime group, a member of an organized crime group who withdrew from the group fewer than five years ago, an associate member of an organized crime group, a person with ties to an organized crime group, a corporate racketeer or a member of other anti-social forces (“organized crime groups, etc.”);
- When a guest is found to belong to a corporation, or other organization the business activities of which are controlled by organized crime groups, etc., or to be a member of such an organized crime group; or
- When a guest is found to belong to a corporation of which the officers are members of an organized crime group, etc., or to be a member of such an organized crime group, etc.
Article 6: Handling of Personal Information
- GRANVISTA shall endeavor to properly manage and use the personal information of guests obtained through the operation of Sea World in accordance with the “Privacy Policy” and the “Information Security Policy” established by GRANVISTA, and guests shall agree to the handling of their personal information in accordance with the provisions of this article.
- GRANVISTA may take photographs of the facilities, performances, etc. within Sea World. In such cases, guests may be the subject of photographs. In addition, the photographed materials may be used for media coverage, advertising, promotions, products for sale, etc.
- Photographs, images, videos, and movies taken by guests in Sea World may be used only for personal use and only as long they do not inconvenience other guests.
- Guests wishing to take photographs, images, videos, or movies of the Cast (not including performers during a performance) should obtain prior permission from the Cast concerned before doing so.
Article 7: Exemptions
GRANVISTA shall not be liable for any damages in the following cases, which shall be the responsibility of the guest.
- accidents between guests in the parking lot;
- incidents of theft on Sea World’s premises;
- accidents caused by the carelessness of guests;
- accidents resulting from fights between guests; or
- accidents caused by guests who do not observe warning signs, advisories, guidance by the Cast, warning notices, etc.
Article 8: Claims for Damages
GRANVISTA will claim compensation from guests for damages in the following cases.
- when facilities, exhibits, or equipment are damaged due to an accident attributable to a guest;
- when a guest commits a prohibited act, such as tampering with an animal and injures the animal, or when such tampering results in the animal concerned to cause injury to other guests; or
- when a guest violates the Terms of Use, resulting in damage to GRANVISTA.
Article 9: Matters requiring the Approval GRANVISTA
The following activities by guests on Sea World’s premises require the prior consent of GRANVISTA.
- use of radios, armbands, flags, or megaphones;
- distributing flyers on Sea World’s premises;
- taking photographs, images, videos, or movies for commercial purposes; and
- commercial use of photographs, images, videos, or movies taken
Article 10: Changes and Restrictions of the Content and Times of Events
- GRANVISTA reserves the right to cancel, suspend, discontinue, change the hours of, restrict, or temporarily close all or part of Sea World for any of the following reasons without prior notice to guests, for as long as it deems necessary.
- for safety, technical or system-related reasons, or facility maintenance;
- reasons relating to the physical condition of the animals, or other reasons determined by Sea World;
- when operation of Sea World is impeded, or GRANVISTA determines that it will be impeded by natural disasters, fire, power outages, or transportation service suspensions;
- if Sea World is requested by a government agency to curtail or suspend its operations due to the spread of an infectious disease, or if the operation of Sea World becomes difficult for other reasons beyond GRANVISTA’s control;
- in the event that GRANVISTA deems that other reasons similar to those listed above have occurred;
- GRANVISTA shall not be liable for any loss or damage incurred by guests as a result of the circumstances described in the preceding paragraphs, except in cases where GRANVISTA is obligated to compensate guests in accordance with laws and regulations
Article 11: Cancellation of Reservations for Events, etc. in Sea World
For services that require reservations, if guests do not show up at the designated time and place for the event concerned due to circumstances that arise after they have applied, the event will be considered cancelled. In such cases, fees will not be refunded.
Article 12: Copyrights
All rights, including ownership rights and copyrights to pamphlets, maps, and other information provided by GRANVISTA to guests using Sea World belong to GRANVISTA, or GRANVISTA has obtained the right to publish such information from a third party.
Article 13: Governing Law
The laws of Japan shall apply to the establishment, validity, performance, and interpretation of the Terms of Use.
Article 14: Language
The Terms of Use have been prepared in Japanese. Translations into other languages, including English, have been prepared based on the Japanese version. In the event of any inconsistencies between the Japanese version and translations into other languages, the Japanese version will take precedence.
Article 15: Competent Court of Jurisdiction
Any dispute arising between guests and GRANVISTA in connection with the Terms of Use shall be resolved through discussions in good faith between the two parties. If the dispute cannot be resolved through discussions, the Kobe District Court shall have exclusive jurisdiction as the court of first instance.
Article 16: Changes to the Terms of Use
GRANVISTA may amend the Terms of Use at any time in accordance with the provisions of Article 548-4 of the Civil Code in response to the establishment, revision, or abolition of any facility, performance, Tickets, or service, changes in precautions, conditions of use, fees, etc., amendments or abolition of applicable laws and regulations, or changes in social conditions, etc. In the event of any amendment, GRANVISTA shall announce or notify guests of their content and effective date by posting on its official website.
